David Resnick & Associates, P.C., a New York personal injury law firm serving injury victims throughout New York City, announced today that attorney Philip Monier obtained a $1,925,000 settlement before trial on behalf of a 38-year-old woman who suffered catastrophic injuries after slipping and falling on a wet and slippery staircase in her building.

The law firm filed the slip-and-fall lawsuit in the Supreme Court of the State of New York, New York County, seeking compensation for the serious physical injuries and disruption to daily life that the woman suffered due to the fall, including going into induced labor and requiring surgical treatment and extensive rehabilitation.

The woman alleged that she suffered sustained tears in the labrum of both hips, as well as injuries to her spine and neck. Following the accident, she was confined to rehabilitation services for several months and required surgery to repair the tears in both hips. The injuries limited the woman's ability to perform daily living activities, including walking, bending, and sitting. She also could not complete regular household chores, sit or stand for long periods, or enjoy her usual activities with her children.

According to the law firm, the building owner and managing agent contended that the fall occurred during an ongoing period of snow and cold-weather precipitation, and they were not required to cover all floors with mats or continuously remove all moisture tracked onto the stairs. They also asserted that they did not create the wet conditions and lacked notice of them.

"We were prepared to call medical and economic experts to demonstrate to the jury the extent of this lovely woman's injuries and the effect they have had, and will continue to have, on her life," says Monier, who has represented accident and injury victims for over 25 years. "When an accident happens as a result of someone's negligence or failure to use reasonable care, the injured party deserves to be fully compensated not only for what that person has gone through since the date of the accident, but also for what the person will go through in the future, for the rest of that person's life. The proceeds from this settlement will help our client deal with her continuing pain and functional difficulties."

This settlement underscores the critical role of premises liability law in protecting tenants and visitors from hazardous conditions.
