A Manhattan woman received a $1.3 million settlement after slipping on water outside her building's elevator, highlighting landlord liability for hazardous conditions.

A New York City personal injury law firm has secured a $1.3 million settlement for a 52-year-old Manhattan woman who suffered catastrophic injuries after slipping and falling on water outside an elevator in her residential building. The settlement, obtained by attorney Philip Monier of David Resnick & Associates, P.C., was reached before trial in the Supreme Court of the State of New York, New York County.
The woman sustained injuries to her right hip, both knees, ankle, and spine, requiring surgery on her hip and ankle. According to Mr. Monier, the injuries have significantly limited her ability to perform daily activities, including walking, bending, exercising, and sitting. She is unable to do regular house chores or sit and stand for extended periods.
The building owner, described as one of the largest landlords in New York City, argued it was not responsible for the injuries. The owner denied negligence, claiming no complaints had been made about the condition and that they lacked notice of the slipping hazard outside the elevator. Despite these arguments, the law firm successfully demonstrated that the owner allowed the hazardous condition to exist for an unreasonable time without taking corrective action.
“Even though the building owner is one of the biggest landlords in the City of New York, they argued that they acted reasonably and were not responsible for the Plaintiff’s injuries and damages — even though they allowed the condition to exist for an unreasonable period of time and did nothing to eliminate its presence,” Mr. Monier said. He added that while the settlement cannot undo the injuries, it will assist the client in living with the residual disabilities caused by the defendant’s negligence.
David Resnick & Associates, P.C., based in Midtown Manhattan, has a reputation for obtaining high-value settlements and verdicts in personal injury cases, including slip-and-fall accidents, auto accidents, pedestrian injuries, subway and escalator accidents, tenant injuries, construction injuries, and other negligence claims. This case underscores the importance of holding property owners accountable for maintaining safe conditions in common areas, as even a momentary lapse can lead to life-altering injuries. The settlement provides financial relief for ongoing medical care and lost quality of life, though it cannot fully compensate for the permanent disabilities suffered.
